A Federal High Court in Kano, presided over by Justice A. M. Liman, on Thursday, April 18, issued an order restraining all parties involved in the suspension of the national chairman of the All Progressive Congress (APC), Abdullahi Ganduje, from enforcing the suspension.
The court specifically prohibited Haladu Gwanjo and eight others from implementing the purported decision made during the alleged emergency meeting of the supposed executive members of the APC Ganduje Ward in Dawakin Tofa local government, which took place on April 15.
It will be recalled that the High Court in Kano, presided by Justice Usman Na’abba, had on Wednesday granted an ex parte order restraining the national chairman of the All Progressives Congress, Abdullahi Ganduje, from parading himself as a member of the party.
Na’abba’s order followed an ex parte motion filed by Dr. Ibrahim Sa’ad on behalf of two executive members of Ganduje’s ward, Dawakin-Tofa Local Government Area, the Assistant Secretary, Laminu Sani, and legal adviser, Haladu Gwanjo (plaintiffs), who were part of the nine ward executives that suspended Ganduje on Monday.
However, Dr. Ganduje, through his legal team, in Suit No. FHC/KN/CS/122/2024 had approached the Federal High Court for the enforcement of his fundamental right to a fair hearing.
The order issued by the court presided over by Justice A. M. Liman, becomes effective from April 17, pending the hearing in a substantive suit in the enforcement of the fundamental human rights of the APC National Chairman as subsumed under Section 46 of the Constitution of the Federal Republic of Nigeria.
The case is now fixed for April 30 for hearing.
